Mosquito Spraying and The Children and Families Protection Act

The Massachusetts Department of Agricultural Resources (DAR) has specific expectations for your IPM plans if you anticipate that spraying for mosquitoes might be necessary. If you have us listed in your IPM plans with the correct pesticides, you should not normally need to request an Emergency Waiver from your local board of health. This would only be necessary if you needed to have the notification time requirements waived (two working days prior to spraying).
Please be certain to have both of the below listed pesticides in your IPM plans.
Anvil 10 + 10, with
Sumethrin and Piperonyl as the active ingredients, EPA reg. number
1020-1688-8329.
Duet, with Prallethrin,
Sumethrin and Piperonyl as the active ingredients, EPA reg. number
1021-1795-8329.

If you have not listed the Plymouth County Mosquito Control Project in your IPM plans, you can only be sprayed through the Emergency Waiver Process. See Emergency Waiver Form and Explanation.
Standard Written Notification requires the distribution of three specific documents to students and staff two working days prior to spraying. In the past all the documents required that paper copies be distributed. This could mean six or seven pages/student. While this remains an option, the DAR has added three electronic options. The three required documents are the Pesticide Standard Written Notification Form (one page), the Consumer Bulletin, and the Pesticide Fact Sheet.

Reminder
of School Obligations
The
law requires that each time a school requests to be sprayed, Standard Written
Notification has to be given to students and parents two working days prior to
the application. The
law also requires the posting of warning signs for any outdoor use of pesticides
on school property. The
accepted warning signs are the small yellow lawn-care flags required by lawn
care regulations. Flags can be purchased from Gemplers at www.gemplers.com or by
calling 1-800-382-8473. Additionally,
the school must post the Standard Written
Notification Form in a central location for 72 hours and records must be
kept on file for five years.
